Request an ASB Case Review
The Anti-social Behaviour, Crime and Policing Act 2014 includes a measure designed to give victims and communities a say in the way that complaints of anti-social behaviour are dealt with, and to help ensure that victims' voices are heard.
The Anti-social Behaviour (ASB) Case Review gives residents of the Basildon Borough the ability to request a formal case review when they feel that the agencies involved such as the Council, the Police or housing provider have not adequately responded to an ASB case reported within the previous six months.
The purpose of a review is to bring agencies together to take a joined up, problem-solving approach to find a solution for the victim.
To qualify for an Anti-social Behaviour Case Review:
- You have reported Anti-social behaviour to the Council, the police or your housing provider three or more times in the last six months
- You have reported a Hate Crime to the Council, the police or your housing provider just once in the last six months
- The reports you have made about anti-social behaviour or hate crime must have been made within one month of the alleged incident taking place
- The application for an ASB Case Review has been made within six months of the report of anti-social behaviour or hate crime to the Council, the Police or housing provider.

Information you will be asked to provide
The ASB Case Review request form is very detailed and you will be asked to provide details of:
- dates when you made a complaint about Anti-social Behaviour (ASB) or Hate Crime to the Council, the Police or your housing provider
- who you reported the incident to
- incident or reference numbers you have been given
- plus further information about the incidents reported

The Anti-social Behaviour (ASB) Case Review process
When you submit a request for Anti-social Behaviour (ASB) Case Review; Basildon Council will ask the agencies involved to provide details of your complaints and any actions they have considered and taken.
A decision will be made as to whether your request for an ASB Case Review meets the local threshold outlined above.
If your request qualifies for a case review
If your request qualifies for an ASB Case Review then you will receive phone call followed by a letter of confirmation advising you of timescale involved and when the case review should be completed by.
A representative of the Safer Basildon Partnership will organise an ASB Case Review meeting inviting all agencies and/or partners that have had involvement in the case.
You will be given the opportunity to attend the first part of the meeting or alternatively requested to complete a Victim Impact Statement with an identified officer (or Victim Support) to be read out.
Agencies attending the meeting will look at what action has been taken in response to the victim's report of anti-social behaviour. Recommendations will be made to the relevant agencies regarding any future action that will need to be undertaken.
The legislation places a duty on a person who carries out public functions to have a regard to those recommendations. This means that they are not obliged to carry out the recommendations, but that they should acknowledge them and may be challenged if they choose not to carry out the recommendations without good reason.
The chair of the meeting will write to the victim detailing:
- the outcome of the case review
- any recommendations made
- the appeals process.
You will receive this letter within 10 working days of the meeting being held.
If your request does not qualify for a case review
If your request does not qualify for an ASB Case Review then you will receive a phone call followed by a letter confirming the outcome explaining why your request has been turned down along with details of the appeals procedure.
Appeals and complaints; if you are not happy with the outcome
You can appeal the decision and outcome of your ASB Case Review. You must submit your appeal in writing within 21 days of receiving your outcome letter.
Your appeal will be forwarded to the Assistant Director of Communities at Basildon Council who will review the details of the case and decide if there are grounds for an appeal.
The Essex Police, Fire and Crime Commissioner will also be notified of the appeal decision.
The ASB Case Review - published information
The Act states that the relevant bodies must publish, at least annually, information relating to the:
- received number of applications for ASB case reviews
- number of times the threshold for review was not met
- number of reviews carried out
- number of reviews that resulted in recommendations being made.
Published information must not include details which could identify victims.
