Insurance claims for damage caused by defects on roads and footpaths

Please note - Insurance claims for damage caused by defects on roads and footpaths such as  potholes should be directed to Essex County Council Highways Service which is the Highways Authority for the majority of roads and footpaths in Essex. Making an insurance claim for personal injury or damage to personal property

If a council tenant or any member of the public feels that they have sustained injury or damage to themselves and/or their property or possessions due to negligence on the part of Basildon Council, they can make a claim for compensation.

The Council's current Public Liability insurers are QBE Insurance Group Limited, policy number Y131097QBE0119A

On receipt of a completed insurance claim form or a letter, the matter will be processed within the established legal timescale. It should be noted that claims made against the Council are civil claims and compensation is not guaranteed.

If, after investigation of an insurance claim's circumstances, it is found that responsibility for the incident lies with another organisation or Authority, such as a contractor or Essex County Council, the insurance Team will advise the claimant accordingly.

Any incident involving a Basildon Council vehicle should be reported in writing to the Insurance Team in order that the claim can be processed. In addition, the claim should be reported to your own motor insurers in order for them to deal with your claim accordingly.

Basildon Council's claims philosophy is built around us being 'firm but fair' when dealing with your insurance claim. 

We will deal with your claim in a timely and accurately manner to ensure that the decisions we make are right the first time, and will endeavour to provide a high standard of customer service so that you understand each step of the claims process fully.  We also endeavour to provide a friendly and professional service to all of our customers and to remain approachable to you at all times.

We aim to complete the claims process for the majority of claims handled in house within 120 days. Each claim is looked at on it's own merit and decisions regarding liability will be made once a detailed investigations has been completed.  These decisions will be made strictly in line with current insurance law and insurance principles and you can be confident that your claim is being dealt with by professional Insurance Officers.

You will always have to right to appeal any decision that you do not agree with and you also always have the right to obtain independent legal advice at any point in the claims process.

Our intention is not to make this process challenging for you at any point, but for us to ensure that only those claims that should be paid, are paid, in order to ensure that we fulfil our duty to protect the public purse.
