Licensing Act 2003

With the new Licensing Act 2003, local licensing powers have now transferred from the courts to Basildon Council

The Licensing Act 2003, grants personal licences to individuals to supply alcohol. The personal licence is separate form the licence which authorised the premises to be used for the supply of alcohol.


The licensing of individuals separately from the licensing of premises permits the movement of personal licence holders from one premises to another allowing greater flexibility.

Personal Licence
Under the terms of the new Licensing Act 2003, licensees of premises which are licensed to sell alcohol are now required to have a personal license.

The new personal license lasts for 10 years and applications should be submitted to the local authority of the district in which the licensee lives.

Personal Licence is a licence for individuals allowing them to sell or supply alcohol for consumption on or off the premises.

To apply for a Personal Licence, applicants must be over 18 years of age and will need to complete
  • An application form
  • Two passport photographs (one of which must be certified as a true likeness),
  • A copy of the applicant’s licensing qualification, a criminal conviction certificate, or a criminal record certificate, or the results of subject access search on the police national computer by National Intelligence Service.
  • A declaration by the applicant that they have not been convicted of a relevant offence or a foreign relevant offence accompanied by details of the nature and date of the conviction and any sentence imposed in respect of it
  • The appropriate licence fee.
Currently no basic criminal record check is available in England and it is recommended that you contact the Scottish criminal records office who will carry out the necessary check.

Premises Licence
Premises Licence is a single scheme for licensing a premise allowing licensable activities to be carried out on that premises. Licensable activities include the sale of alcohol, regulated entertainment such as music, dancing, cinemas and Theatres. Any premises or mobile vehicle selling hot food or drink between 23.00 and 05.00 hrs will also require a premises licence.
